EMPLOYMENT LAWYER

Protecting your rights against your employer

From Sant Feliu de Llobregat we advise workers in the Baix Llobregat and Barcelona, in person and by video call.

A dismissal, a sanction or unpaid wages call for swift, orderly action. We review the letter, the contract, your payslips, the collective agreement, the correspondence and the timeline to identify the possible actions and explain the risks before making a claim.

The deadline to challenge a dismissal is twenty working days, and wage claims are generally subject to a one-year limit. The conciliation request can suspend the time limit or interrupt the limitation period, depending on the action. See the Workers' Statute and the Employment Jurisdiction Act (both in Spanish).

We also handle permanent disability and workplace accident cases, based on the functional limitations, the occupation and the medical and administrative documents. This page provides general information and does not replace an individual analysis of your case.

FREQUENTLY ASKED QUESTIONS

Frequently asked questions about employment law

Employment deadlines can be very short. These answers are for guidance only and must be checked against the dates and documents in your case.

Dismissals, wages and disability

The action against a dismissal expires twenty working days after the date it takes effect. It is a very short time limit. The conciliation request suspends it on the terms laid down by law, but you should not wait to have the letter reviewed and the claim prepared.

As a general rule, the right to claim amounts owed expires one year after it could first be exercised. The calculation must be done item by item and may be affected by steps that interrupt the limitation period.

Many employment claims require an attempt at conciliation or mediation before going to court, although the law provides for exceptions. Filing the request interrupts the limitation period or suspends the time limit, depending on the type of action.

Your dismissal or sanction letter, contract, payslips, the applicable collective agreement if you know it, your Social Security employment record (vida laboral), correspondence with the company, time records and a short timeline of events. For disability or workplace accident cases, medical reports and administrative decisions are also relevant.

Permanent disability does not depend only on the diagnosis, but on how the functional limitations affect the essential tasks of your usual occupation or any work at all, depending on the degree applied for. Your medical history, occupation and specific administrative situation need to be reviewed.
