FAQ

Frequently Asked Questions about Our Legal Services

We answer the questions our clients ask most often about legal services in Barcelona and Catalonia.

General questions

At our firm the first consultation is free and without obligation. We study your case, explain the legal options available and tell you the applicable fees before any work begins. In complex matters it may not be enough to give you a definitive answer; in that case we will propose a preliminary study, with a quote. You can have it in person in Sant Feliu de Llobregat, by phone, by video call or by email.

Yes, we offer both face-to-face meetings at our office in Sant Feliu de Llobregat and video consultations. This way we can assist clients from all over Catalonia and the rest of Spain with the same quality of service.

Employment Law

Compensation for unfair dismissal (despido improcedente) is 33 days' salary per year worked, up to a maximum of 24 months' pay (for contracts after 12 February 2012). For the earlier period, 45 days per year apply, up to a maximum of 42 months' pay. At our firm we offer a free initial assessment of your case and a fixed quote before we act.

The deadline to file a dismissal claim is 20 working days from the date the dismissal takes effect. It is a strict time limit that is only suspended by filing the conciliation request with the SMAC (for up to 15 working days). That is why it is essential to contact an employment lawyer from the very first moment.

A fair dismissal (procedente) is one where the stated reason is proven; it carries no compensation if it is disciplinary, and 20 days per year if it is for objective reasons. A dismissal is unfair (improcedente) when the reason is not proven or the formal requirements are not met, and it carries compensation of 33 days per year. A void dismissal (nulo) is one that breaches fundamental rights or occurs in protected situations (pregnancy, reduced working hours, etc.), and it requires immediate reinstatement with payment of the wages owed in the meantime.

A dismissal during sick leave is not automatically void, but since Law 15/2022 illness has been expressly recognised as a ground of discrimination. If the real reason for the dismissal is your state of health, you can ask for it to be declared void, with reinstatement and compensation for damages. It is up to the employer to prove a different and sufficient reason.

Before going to court you must file a prior claim with the INSS within 30 working days of the notification. The INSS has 45 days to decide and, if it rejects the claim or does not reply, you then have 30 working days to bring proceedings before the employment court. These are short deadlines, and missing them closes the door.

Second Chance and Insolvency

The discharge of unpaid debts allows individuals, whether private persons or self-employed, to cancel the debts they cannot pay, either after liquidating their assets or through a payment plan. It is governed by articles 486 onwards of the Spanish Insolvency Act (Texto Refundido de la Ley Concursal). It is not automatic: you must have acted as a debtor in good faith and meet the legal requirements, which we assess case by case.

Opening insolvency proceedings suspends enforcement actions and ongoing seizures against the debtor's assets. That is a good reason not to wait: the sooner the process starts, the sooner the pressure from creditors stops. It is worth reviewing first which assets and which debts there are, because not all of them receive the same treatment.

Car Accidents

The limit is one year, but it does not run from the accident: it runs from your medical discharge or from the moment the after-effects become stable. In addition, the prior written claim to the insurer interrupts the limitation period, and it is a mandatory step before going to the civil courts.

Not without reviewing it. The insurer must make a reasoned offer, but the assessment of injuries and after-effects under the baremo is open to debate, especially the number of days of impairment and the percentage of after-effects. Signing closes the claim, so it is wise to have the assessment checked first.

Family Law

It depends on the type of procedure. A divorce by mutual agreement is usually resolved within 1 to 3 months of filing. A contested divorce can take between 6 and 12 months or longer, depending on the court's workload and the complexity of the case. In both cases at least 3 months must have passed since the wedding, except in situations of risk.

In Catalonia, the Catalan Civil Code (art. 233-8 et seq.) makes joint custody the preferred arrangement, unless the best interests of the child call for another. The judge considers the emotional bond with each parent, parenting ability, the time devoted to the children before the separation, the children's views if they are mature enough, and how close the parents live to each other. We support you in reaching the best possible agreement.

Child maintenance is set according to the children's needs and the financial means of both parents. The Barcelona courts use the guideline tables of the General Council of the Judiciary (CGPJ) as a reference. They take into account each parent's net income, the number of children, the custody arrangement, ordinary expenses (housing, food, education, healthcare) and extraordinary ones. Maintenance is updated every year in line with the consumer price index (IPC).

Civil Law and Inheritance

In Catalonia you have 30 years from the death of the deceased to accept or renounce an inheritance, under the Catalan Civil Code. However, inheritance tax (Impost de Successions) must be settled within 6 months of the death, which can be extended by a further 6 months if requested within the first 5. We recommend acting as soon as possible to avoid tax surcharges and complications between co-heirs.

It is not compulsory, but it is highly advisable. Without a will, the rules of intestate succession in the Catalan Civil Code (art. 441-1 et seq.) apply, which set a legal order: first children and descendants, then the spouse or stable partner, and then ascendants and collateral relatives. A will lets you name your heirs, distribute assets through legacies, appoint a guardian for minor children and optimise the tax burden. We advise you on planning your estate.

It depends on the court and on whether the tenant opposes the claim. Without opposition the case can be resolved in a few months; with opposition, or if legal aid is requested, it takes considerably longer. What is in our hands is preparing the claim properly from the start: a prior demand for payment, an exact calculation of the debt and joining the claim for unpaid rent to the eviction.

It is the route for claiming against a company or an individual in another EU country, except Denmark, when the amount does not exceed 5,000 euros, excluding interest and costs. It works, for example, for an online purchase that never arrives or a service that is not provided. It is a written procedure using standard forms, and the judgment can be enforced in any other EU country without further formalities. What should be checked first is which court has jurisdiction and how the debt is proved, because a badly prepared form can delay the claim by months.

Company and Commercial Law

An Entrepreneur Service Point (PAE) is an office authorised by the Spanish Ministry of Industry to incorporate companies (SL and SA) and register self-employed workers online through the CIRCE system. Our firm is an official PAE Point, which allows us to complete the whole incorporation in 48 hours: reservation of the company name, drafting of the articles of association, public deed before a notary, registration with the Commercial Registry, obtaining the definitive tax ID and registration with the Tax Agency and Social Security, all in one place.

A self-employed person is liable for debts with all their personal assets, whereas in an SL liability is limited to the capital contributed. Since the Crea y Crece Law (2022), an SL can be incorporated with 1 euro of capital, although at least 20% of profits must go to reserves until they reach 3,000 euros. For tax purposes, the self-employed pay personal income tax (IRPF, progressive rates of up to 47%) and the SL pays corporation tax (25% in general, 15% for new companies in their first two years with a positive tax base). We help you choose the most suitable legal structure.

Tenders and Public Procurement

The usual documentation includes the company's deed of incorporation, tax ID, certificates showing you are up to date with the Tax Agency and Social Security, proof of economic and technical capacity, and any specific documents required by each set of tender specifications. We advise you on the full preparation of your bid.

Yes. Spain's Public Sector Contracts Act (Law 9/2017) provides for a special procurement appeal for contracts subject to harmonised regulation. It is lodged with the competent contract appeals tribunal within 15 working days of notification of the award. For contracts not covered by the special appeal, an administrative appeal for reconsideration or a direct judicial review is available. We assess whether an appeal is viable and the most appropriate strategy.

Criminal Law

If you receive a summons as a person under investigation (investigado), it is essential always to attend with a lawyer. You have the right not to make a statement, not to incriminate yourself and to know the accusation before you testify. We support you from the first summons, study the case beforehand and prepare your defence. It is important not to make statements without a lawyer, as they can seriously harm your position in the proceedings.

Limitation periods vary with the seriousness of the offence: 20 years for offences with a maximum prison sentence of 15 years or more, 15 years if the maximum sentence exceeds 10 years, 10 years if it exceeds 5 years, 5 years for sentences of up to 5 years, and 1 year for minor offences. Terrorism offences with a maximum sentence of 15 years or more, crimes against humanity, genocide and offences against persons in armed conflict do not become time-barred. The limitation period is interrupted when proceedings are brought against the offender.
